Welcome to PokeDras. These Terms & Conditions (“Terms”) govern your use of our website, products, services, and purchases made through our website or any affiliated sales channels. By accessing this website or placing an order with PokeDras, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, please do not use this website or place an order.

1. Eligibility

By using this website, you represent and warrant that:

• You are at least 18 years old, or you are using this website under the supervision of a parent or legal guardian;

• You have the legal authority to enter into binding agreements;

• All information you provide to PokeDras is accurate, current, and complete.

PokeDras may offer products and services including, but not limited to:

• Trading card game products

• Sealed products

• Booster boxes, packs, tins, and accessories

• Individual trading cards (“singles”)

• Pre-order products

• Custom artwork and card-related artwork

• Card restoration services (if applicable)

• Other collectibles, merchandise, and related goods

All products are subject to availability and may be modified, limited, or discontinued at any time without notice.

3. Pricing & Availability

All prices listed on the website are in U.S. Dollars (USD) unless otherwise stated.

PokeDras reserves the right to:

• Change prices at any time;

• Correct pricing errors;

• Limit quantities;

• Refuse or cancel orders due to pricing inaccuracies, inventory issues, suspected fraud, or other legitimate business reasons.

4. Order Acceptance

Placing an order does not guarantee acceptance of that order. All orders are subject to review and approval by PokeDras.

We reserve the right, in our sole discretion, to:

• Refuse or cancel any order;

• Limit quantities purchased per person, household, or order;

• Refuse service to any customer;

• Cancel orders suspected of fraud, abuse, chargeback risk, resale manipulation, or violation of these Terms.

5. Payment Terms

Payment is due in full at the time of purchase unless otherwise stated.

By submitting payment, you represent and warrant that:

• You are authorized to use the payment method provided;

• The billing and payment information submitted is accurate and complete;

• You will not initiate fraudulent or abusive chargebacks or payment disputes.

6. All Sales Final

ALL SALES ARE FINAL.

By purchasing from PokeDras, you expressly acknowledge and agree that:

• All sales are final;

• No returns, exchanges, or cancellations will be accepted once an order has been placed;

• No refunds will be issued for buyer’s remorse, accidental purchases, product preference, opened product outcomes, pack pulls, grading results, or market value fluctuations.

Due to the collectible nature of our products, PokeDras maintains a strict no return / no exchange policy except where required by law or where a written exception is approved by PokeDras in its sole discretion.

7. Refund Exceptions

In the rare event that PokeDras approves a refund or return exception:

• The customer is responsible for all shipping costs, including original shipping and return shipping;

• The refund amount will be reduced by all shipping fees;

• A 10% restocking fee will be deducted from the refund total;

• Refunds, if any, will only be issued after the item is returned (if requested), received, and inspected by PokeDras.

Approval of one exception does not create any obligation to approve future exceptions.

8. Shipping & Risk of Loss

All orders are subject to processing prior to shipment. Estimated shipping timeframes are provided as a courtesy only and are not guaranteed.

Once an order has been transferred to the shipping carrier and accepted for shipment, all risk of loss passes to the customer to the fullest extent permitted by law.

PokeDras is not responsible for:

• Lost packages

• Stolen packages

• Delayed deliveries

• Misdelivered packages

• Carrier scanning issues

• Carrier transit damage after acceptance

Any issues involving shipping must be handled directly with the applicable carrier.

9. Pre-Orders

By purchasing a pre-order item, you acknowledge and agree that:

• Release dates are determined by manufacturers, distributors, or licensors and may change without notice;

• PokeDras is not responsible for manufacturer or distributor delays;

• Pre-order shipping dates are estimates only;

• Allocation shortages may occur due to supplier limitations.

If we receive less inventory than expected, orders may be delayed, reduced, partially fulfilled, or canceled at our discretion.

10. Product Condition / Collectibles Disclaimer

Due to the nature of trading cards and sealed collectibles:

• Minor packaging imperfections, seal variance, print variance, centering issues, factory defects, or cosmetic flaws do not qualify for a refund, return, or exchange;

• PokeDras does not guarantee specific pulls, hit rates, rarity distribution, centering, grading outcomes, or future market value;

• Opening sealed product is done at the customer’s own risk.

For singles, condition assessments are made in good faith and may involve reasonable subjective judgment unless specifically guaranteed in writing.

11. Artwork / Custom Work / Restoration

All artwork, custom work, and restoration-related sales are final unless otherwise agreed in writing.

Unless expressly stated otherwise in writing:

• PokeDras retains all intellectual property rights in artwork and designs;

• Purchase of artwork does not transfer copyright or reproduction rights;

• Restoration results are not guaranteed;

• PokeDras is not responsible for grading outcomes, resale value, or third-party grading decisions after restoration or cleaning services.

12. Intellectual Property

All content on this website, including but not limited to logos, graphics, product descriptions, text, videos, images, artwork, and design elements, is the property of PokeDras and/or its licensors and may not be copied, reproduced, distributed, or used without prior written permission.

13. Third-Party Brand Disclaimer

PokeDras may sell products or display content related to third-party brands, franchises, and games.

All third-party trademarks, logos, and copyrights remain the property of their respective owners.

PokeDras is not affiliated with, endorsed by, sponsored by, or officially associated with The Pokémon Company, Nintendo, Game Freak, Creatures Inc., Bandai, Toei, Konami, or any other third-party rights holder, unless expressly stated otherwise.

14. Chargebacks & Payment Disputes

By completing a purchase, you agree to contact PokeDras first to attempt to resolve any issue before initiating a chargeback or payment dispute.

Improper, abusive, or fraudulent chargebacks may be contested using:

• Order records

• Tracking confirmation

• Policy acceptance records

• Transaction documentation

PokeDras reserves the right to:

• Refuse future service;

• Cancel pending orders;

• Pursue recovery of funds, fees, and administrative costs to the fullest extent permitted by law.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS WEBSITE, ALL PRODUCTS, AND ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKEDRAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

In no event shall PokeDras’s total liability exceed the amount actually paid by the customer for the specific product or service giving rise to the claim.

17. Governing Law

These Terms and any dispute arising out of or relating to your use of the website, products, services, or transactions with PokeDras shall be governed by the laws of the State of Minnesota, without regard to conflict of law principles.

18. Venue

Any dispute shall be brought exclusively in the state or federal courts located in Minnesota, and you consent to the jurisdiction and venue of such courts.
